PARENT AND CHILD รข€” DIVORCE รข€” CUSTODY. 1. Parent and Child รข€” No presumption as to fitness of parent. Montana law recognizes no presumption of fitness in a parent, except, other things being equal, if the child is of tender years. 2. Parent and Child รข€” Parents right not absolute. Parents right to custody of minor child is not an absolute right, even though it is conceded that the parent is a fit and proper person to have such custody. 3. Parent and Child รข€” Best interest of child รข€” No abuse of discretion. Court did not abuse its discretion in holding that the best interests of children, 13, 11, and 10 years of age, required that their custody remain with paternal grandmother, with whom they had lived since infancy under agreement of parents and award of court, and who had always splendidly raised them, rather than be given to natural mother who had not had custody of her children for over 10 years and who had shown no more than casual interest in them.
